JACKSON — A Mississippi appeals court has refused to reinstate a drunk driving conviction it threw out earlier this year against a woman whose impaired driving killed a mother and child in 2021.

The Mississippi Court of Appeals denied the state’s request for rehearing Monday without explanation in the case of Beth Ann White, leaving in place its earlier decision to overturn one of her five DUI convictions.

White was convicted in Hinds County Circuit Court in 2024 on all five counts stemming from a November 1, 2021, crash that killed two people and seriously injured two others.

Allison Conaway and her six-month old son, Alex, were killed in the crash and her two daughters were critically injured.

The appeals court upheld four of those convictions but threw out a fifth, a repeat-offender DUI charge, ruling that prosecutors added it too late under the state’s two-year statute of limitations.

Attorney General Lynn Fitch’s office had asked the court to reconsider, arguing that White’s arrest on the day of the crash started the clock on the entire prosecution, including the repeat-offender charge. The court declined Monday to revisit that ruling.

White remains convicted on the four aggravated DUI counts. The case was tried in Hinds County Circuit Court before Judge Winston Kidd.
